Terms of Use
These Terms of Use (“Terms”) govern your use of the SimplePresent app (“the app”, “we”, “us”). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.
Eligibility
You must be able to form a legally binding agreement to use the app. The app is not intended for children under 13, and they should not use it.
The service
SimplePresent helps you remember gift-giving occasions and suggests gift ideas generated with the help of AI. Suggestions are abstract categories (for example, “pour-over coffee set”), not specific products, brands, prices, or endorsements. The app is provided free of charge; there are no subscriptions and no in-app purchases.
AI-generated suggestions
Gift ideas are produced by an automated AI system and may be inaccurate, incomplete, or unsuitable for a given person or occasion. They are suggestions only — always use your own judgement before making a purchase.
Affiliate links
The app contains Amazon affiliate links. Tapping a gift idea opens an Amazon search page in your browser that includes our affiliate tag. As an Amazon Associate, we may earn from qualifying purchases. We do not control and are not responsible for products, prices, availability, content, or transactions on Amazon; those are subject to Amazon's own terms and policies.
Third-party services
The app relies on third-party services, including Amazon (affiliate product search), Google (the Gemini API for generating ideas, and Firebase for anonymous authentication, analytics, and crash reporting), and AppsFlyer (install attribution and measurement). Your use of features that depend on these services is also subject to those providers' own terms and privacy policies.
Acceptable use
You agree not to misuse the app, including: interfering with or disrupting the service or our backend; attempting to bypass rate limits or security measures; reverse-engineering the app except where permitted by law; or using the app for any unlawful purpose.
Intellectual property
The app, together with its design, brand, and content (excluding third-party content), is owned by us or our licensors and is protected by applicable laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose.
No warranty
The app and its suggestions are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or availability. We do not warrant that the app will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of (or inability to use) the app, including any purchases you make on Amazon or other third-party services.
Changes
We may update these Terms from time to time. The “Last updated” date above reflects the latest version, and your continued use of the app after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the applicable laws of our principal place of business, without regard to its conflict-of-laws rules.
